The TAR ruling ruled that the prison officer’s suitability for carrying out his job was called into question, “conveying the idea that the homosexuality attributed to him could be a personality disorder“.

According to what was reported by the prison officer, during the disciplinary proceedings he was asked specific ambiguous questions regarding his sexual orientation, only to be subsequently sent – for psychiatric tests – to the Hospital Medical Commission of Milan, where they found nothing significant. In the end they closed the disciplinary proceedings against him.
