Italy, prison policeman forced to undergo psychiatric tests because he was suspected of being gay

The Regional Administrative Court (TAR) of Piedmont has condemned the Ministry of Justice to compensate a prison police officer with the sum of 10,000 euros for “moral damages”

The TAR ruling ruled that the prison officer’s suitability for carrying out his job was called into question, “conveying the idea that the homosexuality attributed to him could be a personality disorder“.

Furthermore, according to the ruling, the decision to order that particular test was “arbitrary and without any legal or technical basis“.

According to what was reported by the prison officer, during the disciplinary proceedings he was asked specific ambiguous questions regarding his sexual orientation, only to be subsequently sent – for psychiatric tests – to the Hospital Medical Commission of Milan, where they found nothing significant. In the end they closed the disciplinary proceedings against him.
